By accessing or using the website located at concretebridgewater.com (the "Site"), or by engaging Bridgewater Concrete ("we," "us," or "our") for services, you agree to these Terms and Conditions. If you do not agree, do not use the Site or engage our services. These terms apply to all visitors, estimate requests, and customers.
Bridgewater Concrete provides concrete contracting services, including but not limited to driveway installation, patio construction, foundation work, flatwork, decorative concrete, and related services. All services are performed in the Bridgewater, MA area and surrounding communities.
We reserve the right to decline any project at our discretion. Our acceptance of an estimate request or inquiry does not constitute a binding agreement to perform services. A binding agreement is formed only when both parties have signed a written contract or work order.
Written estimates provided by Bridgewater Concrete are based on information available at the time of the site visit and are valid for 30 days from the date issued, unless otherwise stated in writing.
Estimates are not guaranteed final prices. Changes to scope, unforeseen site conditions, changes in material costs, or requests made by the customer after an estimate is issued may result in a revised price. Any changes to the original scope of work will be documented in writing and require the customer's written approval before additional work proceeds.
Verbal quotes or ballpark figures provided prior to a site visit are estimates only and are not binding.
Project start dates are estimated based on crew availability and weather conditions at the time of scheduling. We will communicate changes to the scheduled start date as soon as reasonably possible.
Concrete work is weather-dependent. We reserve the right to reschedule any project if weather conditions are unsuitable for a safe or quality pour. This includes extreme cold, heavy rain, or other conditions that would compromise the finished product.
If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellations made after materials have been ordered or delivery has been scheduled may result in restocking or cancellation fees, which will be communicated to you in advance.
Payment terms are specified in the written contract or work order for each project. A deposit may be required before work begins. The remaining balance is due upon completion of the project unless otherwise agreed in writing.
Accepted payment methods will be communicated at the time of contracting. Checks, cash, and other methods may be available depending on the project.
Invoices not paid by the due date stated in the contract may be subject to a late fee or interest charge at the maximum rate permitted by Massachusetts law. We reserve the right to pursue collection through legal means for unpaid balances.
You agree to:
We are not responsible for damage to underground utilities or structures that were not disclosed to us prior to work beginning.
For projects requiring a building permit from the Town of Bridgewater or another municipality, we will apply for the required permit before work begins unless otherwise agreed in writing. Permit fees will be included in the project estimate or invoiced separately and are the responsibility of the customer. We will not proceed with permitted work until the permit has been issued.
We warrant that all work will be performed in a professional manner consistent with industry standards for concrete construction in Massachusetts. Specific warranty terms, if any, will be set out in the written contract for each project.
Normal hairline surface cracking is an inherent characteristic of concrete and is not covered by any workmanship warranty unless caused by a defect in installation. Damage resulting from misuse, failure to follow care instructions, freeze-thaw cycles affecting an improperly maintained surface, use of chemical de-icers during the first winter, vehicle overloading, or acts of nature is not covered.
Warranty claims must be submitted in writing to estimates@concretebridgewater.com within the warranty period stated in your contract. We will inspect the issue and determine whether it falls within the warranty scope at our discretion.
To the fullest extent permitted by Massachusetts law, our total liability to you for any claim arising out of or related to services provided under these terms shall not exceed the total amount paid by you for the specific project giving rise to the claim.
We are not liable for indirect, incidental, consequential, punitive, or special damages, including loss of use, loss of income, or damage to other property, arising from our services or any delay in performing those services.

If informal resolution is not successful, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in Bridgewater, MA, unless both parties agree in writing to another method. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms and Conditions and any disputes arising from them are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought in the courts of Plymouth County, Massachusetts.
